Neutralitätsauflagen für Provider sind in den USA heftig umstritten. Die von der FCC ausgesprochene Abmahnung für den US-Kabelnetzbetreiber Comcast war im vergangenen Monat von einem Bundesgericht gekippt worden, das keine rechtliche Grundlage für etwaige Auflagen für Provider sah. Die FCC hatte auf die Schlappe mit der Eröffnung des “dritten Wegs” reagiert: Die bisher als Informationsdienste locker regulierten Internetzugangsanbieter als Betreiber von Telekommunikationsnetzen einzustufen und damit einem strikteren Regulierungsregime zu unterwerfen.

Gemäß dem jetzt angekündigten Vorhaben Genachowskis sollen Internetprovider künftig als klassische Telekommunikationsanbieter und Carrier eingestuft werden. Das damit theoretisch verfügbare umfangreiche Arsenal an Regulierungsmitteln will die FCC aber nur zum Teil auf die Zugangsanbieter anwenden.
